What you need to know:
Section 1 of H.1599 and S.1114, would allow minors to consent to vaccination by making the same changes to Chapter 112 of Section 12F as those proposed in the Community Immunity Act.
These changes would:
- Allow a minor of any age and intellectual capacity to consent to vaccination, without parental knowledge or consent, and
- Keep the record of the vaccination hidden from parents.
If
the Community Immunity Act does not move forward, but H.1599/S.1114
became law, minors would be able to consent to vaccination as described
above.
The Supreme Court has held unequivocally that parents have the right to make medical decisions for their minor children.
Keeping
parents in the dark about vaccinations their minor children have
received is simply bad policy. Parents need to know their children’s
vaccination history so they can make informed decisions about future
medical treatment, including future vaccinations.
The
language is in no way limited to “mature” minors – as written, a minor
who is unable to effectively communicate or who doesn’t have the
intellectual capacity to provide informed consent would be able to
consent to vaccination if these bills are enacted. There is no minimum
age requirement.
It is critical that this language in the bill is brought to the attention of the committee and removed.
Where in the Act enhancing access to abortion care (bills H.1599 and S.1114) does it state that minors are allowed to consent to vaccination without parental consent or knowledge?

current law is edited (see next slide for a redline showing the change).
Section
1 of these bills changes only a few words, but the impact is
significant. Currently, the law allows, in narrow and specific
circumstances, minors to consent to medical care without parental
knowledge or consent and blocks parental access to medical records of
that care.
The
changes proposed by Section 1 would broaden the circumstances when
minors can consent to care, allowing them to consent to care for the
“prevention” of diseases, which would include vaccination.
